1. Parties

Guest: the natural person identified at booking, acting as consumer pursuant to Art. 3 D.Lgs. 206/2005 (Italian Consumer Code).

2. Object of the Contract

Short-term rental of the holiday accommodation Casa Mario in Riparbella for a specific period and specific number of guests, as confirmed in the booking confirmation email. The property is rented for tourism purposes only ("locazione turistica") under Art. 53 D.Lgs. 79/2011 and excludes any commercial, residential, or extended use.

3. Conclusion of the Contract

The rental agreement is concluded when:

  1. The Guest selects dates and confirms personal details on casa-mario.it;
  2. The Guest accepts the cancellation policy, these terms, and the privacy policy (two distinct checkboxes in step 2);
  3. The Guest clicks the unambiguous payment-obligation button ("Order and pay €X" or equivalent in the chosen language) in step 3;
  4. Payment is successfully processed by Stripe Payments Europe Ltd; and
  5. The Guest receives an automatic email confirmation (durable medium pursuant to Art. 51(1) D.Lgs. 206/2005).

4. Price and Payment

All prices are shown in Euro (EUR), inclusive of all mandatory charges and applicable taxes, except for the imposta di soggiorno, which is shown separately and paid in cash at check-in unless otherwise indicated.

Payment methods accepted: card payments via Stripe Payments Europe Ltd. Strong Customer Authentication (SCA) under PSD2 / Reg. (UE) 2015/2366 may be required by your card issuer (3D Secure verification).

5. Tourist Tax (Imposta di Soggiorno)

The imposta di soggiorno of the Comune di Riparbella applies (€1 per person per night, applicable to all guests aged 18 and over, maximum 7 consecutive nights). The amount is shown separately during booking and paid in cash on arrival. Receipt is provided.

6. Cancellation Policy

The Guest may cancel a booking by email at info@casa-mario.it. The applicable refund will be issued via Stripe within 14 days of cancellation confirmation.

7. Exclusion of the Right of Withdrawal

8. Check-in and Check-out

Check-in from 16:00, check-out by 10:00. The Guest must provide identification (passport / EU identity card) at check-in for police registration (Schedine Alloggiati, Art. 109 TULPS) within 24 hours. Refusal to provide ID prevents the Lessor from fulfilling this legal duty and may result in the booking being terminated without refund.

10. Security Deposit

No upfront security deposit is collected. The Guest agrees to compensate the Lessor within 14 days for any damages identified at check-out exceeding normal wear and tear. Disputed damages may be escalated through ADR (see Art. 14 below).

11. Force Majeure

Neither party is liable for non-performance caused by force majeure (events beyond reasonable control, including natural disasters, strikes affecting transport, public authority orders restricting travel). In such cases the parties will negotiate in good faith for a date change or proportional refund.

12. Lessor Liability

The Lessor's liability is limited to the value of the booking. The Lessor is not responsible for loss of personal belongings, accidents not caused by Lessor negligence, or inconveniences related to third-party services (chef, transfers, etc.) arranged on Guest's request — these are direct contracts between the Guest and the third-party provider.

13. Personal Data

Personal data processing is governed by our Privacy Policy. By accepting these terms the Guest acknowledges the privacy notice ex Art. 13 GDPR.

14. Applicable Law and Dispute Resolution

These terms are governed by Italian law. The Italian language version prevails in case of inconsistency.

For consumer disputes the Guest may, pursuant to Art. 66-bis Codice del Consumo, bring proceedings before the court of his/her own habitual residence within the European Union.

Alternative Dispute Resolution (ADR): The Guest may use any ADR mechanism available under Title II-bis Codice del Consumo or "conciliazione paritetica" through Italian consumer associations. (The EU Online Dispute Resolution Platform was withdrawn on 20 July 2025 by Reg. (UE) 2024/3228.)

15. Pre-contractual Information Confirmation

Pursuant to Art. 49–51 D.Lgs. 206/2005 / Art. 6–8 Directive 2011/83/EU, all required pre-contractual information has been provided on the booking page and the Guest's email confirmation. By completing the booking the Guest acknowledges having received clear and comprehensible information regarding identity of the trader, main characteristics, total price including all taxes, payment arrangements, performance terms, cancellation rights, and the exclusion of the right of withdrawal.
